These Terms of Service (“Terms”) govern your use of the Phonekit Cleaner mobile application (“App”) . By downloading, installing, or using the App or Services, you (“you” or “User”) agree to be bound by these Terms, as well as our Privacy Policy (available in the App under “Settings > Privacy Policy”). If you do not agree to these Terms, do not use the App or Services.
1. Eligibility
You must be at least 13 years of age to use the App and Services. By using the App, you represent and warrant that: (a) you are 13 years of age or older; (b) you have the legal capacity to enter into these Terms; and (c) your use of the App complies with all applicable laws, regulations, and policies in the United States. If you are using the App on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Scope of Services
The App provides file management and related services for iOS devices, including but not limited to:
File format conversion (e.g., PDF to Excel, Word to PDF, image to PDF);
Photo and video organization (e.g., detecting duplicate or similar media, categorizing files);
Camera scanning to convert Photos to PDF;
Local storage of files, scanned content, and private album data;
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.
3. User Responsibilities
3.1 Content Ownership & Compliance
You retain full ownership of all files, photos, videos, and other content (“User Content”) that you upload, process, or store using the App. By using the Services, you represent and warrant that:
You have the legal right to access, use, and store all User Content in the App;
User Content does not violate any applicable laws, third-party rights (e.g., copyright, trademark, privacy, or publicity rights), or these Terms;
User Content is not illegal, harmful, defamatory, obscene, harassing, or otherwise objectionable.
We may, in our sole discretion, remove or restrict access to User Content that violates these Terms, but we are not obligated to monitor User Content for compliance.
3.2 Proper Use of the App
You agree to use the App and Services only for lawful purposes and in a manner that does not:
Interfere with or disrupt the App’s functionality, servers, or networks (e.g., through malware, spamming, or overloading);
Attempt to gain unauthorized access to the App’s code, user data, or third-party systems;
Modify, reverse-engineer, decompile, or create derivative works of the App;
Use the App to distribute malware, phishing content, or illegal materials;
Violate Apple’s App Store Guidelines or any other applicable platform rules.
3.3 Permission Management
As described in our Privacy Policy, this app requires certain device permissions (e.g., camera, photos, contacts, calendar, local storage) to provide core services. You are responsible for managing these permissions through your iOS device settings ("Settings > File Manager"). We will not access or use device features (e.g., camera, photos) without your explicit consent, and disabling necessary permissions may limit your ability to use certain services (e.g., scanning to PDF).
4. Intellectual Property Rights
4.1 App Ownership
The App, including all code, design, trademarks, logos, and content provided by us (excluding User Content), is owned by us or our licensors and protected by U.S. copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written permission.
4.2 License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device solely for your own personal or business use, in accordance with these Terms. This license does not allow you to:
Distribute, sell, rent, or sublicense the App to any third party;
Use the App for commercial purposes not authorized by us (e.g., reselling access to the Services);
Copy or modify the App’s code or design.
5. Third-Party Services
The App may integrate with third-party services (e.g., Firebase, AppsFlyer, AdMob) as described in our Privacy Policy. These third-party services are governed by their own terms of service and privacy policies, not these Terms. We are not responsible for the performance, content, or privacy practices of any third-party service. Your use of third-party services is at your own risk.
6. Disclaimer
The App and Services are provided without warranties of any kind, whether express or implied. We expressly disclaim all warranties, including, but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
Warranties that the App will be error-free, uninterrupted, or secure;
Warranties regarding the accuracy, reliability, or completeness of user content processing (e.g., format conversion, duplicate detection).
We make no warranty that the App will meet your specific requirements or that any errors in the App will be corrected. Your use of the App and Services is at your own risk.
7. Limitation of Liability
To the maximum extent permitted by U.S. law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, lost profits, lost data, or loss of use, arising out of or in connection with your use of the App or Services.
Our total liability to you for any claim arising out of these Terms or your use of the App will not exceed $100. This limitation applies even if we have been advised of the possibility of such damages.
8. Termination
We may terminate or suspend your access to the App and Services at any time, with or without notice, if:
You breach these Terms or our Privacy Policy;
We suspect unauthorized or fraudulent use of the App;
We discontinue (in whole or in part) the App or Services.
Upon termination, your license to use the App will immediately terminate, and you will delete the App from your device. We will not be liable for any termination of your access to the App.
9. Changes to These Terms
We may periodically update this Privacy Policy to reflect changes in our practices or applicable law. We will notify you of significant updates through in-app notifications or app updates.
Your continued use of the App or Services after the updated Terms take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms regularly.
10. Termination
We may suspend/terminate your access to the App (without notice) if:
●You violate these Terms or our Privacy Policy;
●Your use poses a risk to us/others;
●Required by law/court order.
You may terminate by uninstalling the App. Post-termination:
●Your license ends;
●We delete non-personal data (per Privacy Policy);
●Sections 6–8, 11–12 survive.
11. Governing Law & Disputes
These Terms are governed by California law (excluding conflict of laws rules).
Before filing a claim, you must attempt to resolve disputes via good-faith negotiation (contact us first). If unresolved in 30 days, disputes go to **binding arbitr
ation** (AAA Consumer Rules, San Francisco or remote). You and we waive jury trials for covered disputes.
You may file claims with government agencies (e.g., FTC) or small claims court (if eligible).

We offer both free and paid Services. If you choose to subscribe to a paid Service, you agree to pay the fees ("Fees") as quoted to you when you purchase that Service. We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase. You are responsible for all charges related to using the purchased Service (for example, data charges and currency exchange settlements). You will pay the Fees in the currency We quoted at the time of purchase. We reserve the right to change the eligible currencies at any time, except where not permitted by applicable law. We reserve the right to change its prices at any time. However, if we have offered a specific duration and Fee for your use of the Service, we agree that the Fee will remain in force for that duration.

You can cancel auto-renewal at any time, given that the cancellation is at least 24 hours before the end of the current period. Any unused portion of a free trial period will be forfeited when making a purchase of an auto-renewing subscription.
